Bu nedenle kiralayan, icra dairesine ba\u015fvurarak, kirac\u0131ya tebli\u011f edilmesi \u00fczere bir <strong>\u00f6deme emri <\/strong>\u00e7\u0131kar\u0131r.<\/p>\n<p>Bu emre g\u00f6re, kirac\u0131n\u0131n 30 g\u00fcn i\u00e7erisinde kira bedelini \u00f6demesi istenir. Kirac\u0131n\u0131n s\u00f6z konusu emre 7 g\u00fcn i\u00e7erisinde itiraz etmeye hakk\u0131 vard\u0131r. E\u011fer itiraz etmez, ya da itiraz\u0131 ret olunursa, 30 g\u00fcn doldu\u011funda halen kira bedeli \u00f6denmemi\u015fse, art\u0131k yetkili mahkemeye ba\u015fvurularak tahliye davas\u0131 a\u00e7\u0131l\u0131r.<\/p>\n<p>E\u011fer kirac\u0131n\u0131n itiraz\u0131 kabul edilirse, tahliye davas\u0131 a\u00e7\u0131lamaz.<\/p>\n<p>30 g\u00fcn i\u00e7erisinde kirac\u0131n\u0131n birikmi\u015f kira bedellerini t\u00fcm gereklere uygun olarak \u00f6demesi durumunda, kiralayan ki\u015finin art\u0131k \u201ckira bedelinin temerr\u00fcd\u00fc\u201d sebebine dayanarak tahliye davas\u0131 a\u00e7mas\u0131 olanaks\u0131zd\u0131r. Ancak, ayn\u0131 kira y\u0131l\u0131 i\u00e7erisinde tekrar temerr\u00fct hali ger\u00e7ekle\u015firse o zaman tahliye davas\u0131 a\u00e7\u0131labilir.<\/p>\n<p>Belirtelim ki, bu davan\u0131n a\u00e7\u0131labilmesi i\u00e7in, yani yarg\u0131lama a\u015famas\u0131na gelinebilmesi i\u00e7in, kiralayan\u0131n kirac\u0131ya en az iki defa ihtarname \u00e7ekmi\u015f olmas\u0131 gerekir.<\/p>\n<ul>\n<li><strong><em>T\u00fcrk Bor\u00e7lar Kanunu kapsam\u0131na al\u0131nan genel tahliye sebeplerine dayan\u0131larak tahliye davas\u0131 a\u00e7\u0131labilir.<\/em><\/strong><\/li>\n<\/ul>\n<p>G\u00fcncel hukuktaki geli\u015fmelere g\u00f6re, yukar\u0131da yazd\u0131\u011f\u0131m\u0131z sebebin d\u0131\u015f\u0131nda, \u00f6ncelikle ev sahibinin kirac\u0131y\u0131 tahliye etmek i\u00e7in, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun ilgili (md.299 ve devam\u0131) maddelerince ortaya konan HAKLI SEBEPLERE ihtiyac\u0131 vard\u0131r. Bunlar:<\/p>\n<p>&nbsp;<em>-Mal sahibinin veya ailesinden bir ferdin s\u00f6z konusu ta\u015f\u0131nmaza olan hakl\u0131 ihtiyac\u0131, (kiralanan\u0131n konut ya da i\u015f yeri olarak kullan\u0131lma ihtiyac\u0131, ya da yeni malikin buraya konut\/i\u015f yeri olarak ihtiya\u00e7 duymas\u0131 gibi)<\/em><\/p>\n<p><em>-Ta\u015f\u0131nmaz\u0131n yeniden in\u015fa ya da imar edilmesi, tadilata sokulma zorunlulu\u011fu, <\/em><\/p>\n<p><em>-Kirac\u0131n\u0131n kiralayana bir \u201ctahliye taahh\u00fcd\u00fc\u201d vermi\u015f olmas\u0131, (Kirac\u0131n\u0131n belirli bir tarih i\u00e7in kiralayana kar\u015f\u0131 kay\u0131ts\u0131z ve \u015farts\u0131z olarak kiralanan \u015feyi tahliye edece\u011fine dair taahh\u00fctte bulunmas\u0131d\u0131r.
